FAFE Court Update

On Wednesday afternoon, Judge Wolford heard testimony from both Waste Management and New York City on why they believe Fresh Air for the Eastside’s case should be dismissed. In January of this year, WM filed a motion to dismiss the case, and NYC followed suit with their own motion in February. Their requests to dismiss are in direct response to FAFE’s complaint against both WM and NYC for the ongoing odor nuisance faced by our community. This oral argument provided all three parties, and the legal team for an additional class-action lawsuit, to argue their cases in front of Judge Wolford.

FAFE Denied Transparency from Perinton Town Board

On December 20, 2018, FAFE legal counsel, Knauf Shaw LLP, submitted a Freedom of Information Law (FOIL) Request to view draft documents for the Host Community Agreement (HCA) with Waste Management’s High Acres landfill. The Perinton Town Board (PTB) continues to state that that the request is “premature”, as Town staff has yet to complete its internal evaluation of its legal counsel’s draft Host Community Agreement.

On April 5, Waste Management released a community update to inform residents that, on April 3, high winds resulted in damage to exposed portions of the geomembrane cover at High Acres.  In recent months, both Waste Management (WM) and the NYS Department of Environmental Conservation (NYSDEC) have applauded the speedy installation of this geomembrane cover, and have promised that its implementation would result in a significant decrease in odors experienced by the community...
